Cyber Security Law is a new and evolving concept. As our society attempts to come to grips with the rapidly evolving internet and its new opportunities and legal challenges, once must be mindful that these opportunities and challenges have evolved in a huge vacuum between the technology and the laws which are necessary to secure and govern it. Hence the U.S. does not have a single, comprehensive, overarching statute governing Cyber Security Law at either the federal or state level.
In order to advise clients in Cyber Security Law, Attorney Coughlin has invested and continues to invest a significant amount of time developing expertise in Cyber Security Systems Concepts, as well as, Cyber Security Applicable Statutory and Common Laws and procedures for mitigating the effects of Identity Theft.
These Cyber Security applicable laws include FTC Act Section 5, US Constitution Article 3 Standing, US Constitution 14th Amendment regarding Search and Seizure, Causes of Action such as Data Breach, Negligence, Negligent Misrepresentation, Breach of Contract, Breach of Warranty. Gramm Leach Bliley Act, Creditor Red Flag Rules, FTC Safeguards Rule, HIPAA Security Rule , PCI- DSS, US Digital Millennium Copyright Act, US Computer Fraud and Abuse Act, and the US Economic Espionage Act.
